Eligibility and accounts

You must be at least 18 years old. You are responsible for keeping your sign-in credentials secure and for everything done through your account. Give us accurate information and keep it current.

What we sell

FoxySim sells prepaid mobile data plans delivered as eSIM profiles. Plans are provided in partnership with local mobile network operators through our connectivity provider. Each plan states its data allowance, validity period and the countries it covers. Plans are data only: they do not include a phone number, calls or SMS.

Device requirements

You need an eSIM-capable device that is carrier-unlocked. The app checks whether your device reports eSIM support before purchase, but it cannot detect carrier locks or regional restrictions. Confirm compatibility with your device manufacturer or carrier before you buy.

Activation and validity

A plan's validity starts when the eSIM first connects to a supported network in the destination, or, for some plans, at installation, as stated on the plan. Once validity starts, it runs continuously and cannot be paused. Unused data expires with the plan. Each eSIM profile can be installed on one device once; deleting an installed profile from your device may make it unusable.

Prices and payment

Prices are shown in US dollars unless stated otherwise and include applicable taxes where the payment processor collects them. Payments are processed by Paddle, which acts as merchant of record. Top-ups are charged at the price shown in the app at the time of purchase. Refunds are handled under our Refund policy.

Network coverage and speed

Coverage, speed and network technology depend on the local operator and on where you are, and may vary. We do not guarantee uninterrupted service, particular speeds, or availability of any specific network, and we are not responsible for outages or restrictions imposed by local operators or authorities.

Acceptable use

You agree not to:

• Use the service for anything unlawful, or in breach of local telecommunications rules.
• Resell plans or eSIM profiles, or use them for machine-to-machine or commercial traffic without our written agreement.
• Attempt to bypass usage limits, tamper with the app, or interfere with our systems.
• Use the service in a way that harms other users or the networks it relies on.

Disclaimer and limitation of liability

The app and the plans are provided on an as-is and as-available basis, without warranties of any kind beyond those that cannot be excluded by law. To the fullest extent permitted by law, MontiGate's total liability for any claim relating to the service is limited to the greater of one hundred US dollars or the amount you paid us in the twelve months before the claim, and we are not liable for indirect, incidental or consequential losses.

Suspension and termination

We may suspend or close accounts that breach these terms or that are used for fraud or abuse. You may close your account at any time in the app. Closing an account does not refund active plans.

Changes to the service or these terms

We may change plans, prices and app features at any time; changes do not affect plans already purchased. We may update these terms, and we will post the new date at the top. Continued use after a change means you accept the updated terms.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. We will try to resolve any dispute with you informally first; failing that, disputes are resolved by the courts or by arbitration as permitted where you live.
